By accessing or using the website located at powayconcretecompany.com (the "Site"), or by engaging Poway Concrete Company ("we," "us," or "our") for any concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or our services.
Poway Concrete Company provides residential and commercial concrete contracting services in Poway, CA and surrounding areas. Services include but are not limited to concrete driveways, patios, sidewalks, pool decks, retaining walls, foundations, floors, and related concrete work.
Use of this Site does not constitute an agreement to provide services. A formal written estimate and a signed project agreement are required before any work begins.
All estimates provided by Poway Concrete Company are free and are based on an on-site assessment of your property. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
An estimate is not a binding contract. Work will begin only after you have reviewed and signed a written project agreement that includes a final scope of work and price. If conditions discovered during project preparation differ materially from what was assessed at the time of estimate - such as unexpected soil conditions or the discovery of buried obstructions - we will notify you and obtain your approval before proceeding with any additional work or charges.
All pricing is in U.S. dollars. We reserve the right to adjust pricing to reflect changes in material costs or labor prior to contract execution.
Project start dates are scheduled after a signed agreement and any required deposit are received. We will provide a written schedule before work begins. Schedules may be adjusted due to weather conditions, material availability, permit delays, or other factors outside our control. We will notify you of changes as soon as practical.
If you need to reschedule or cancel a project, please notify us in writing as soon as possible. Cancellations made after project materials have been ordered or permits have been pulled may result in fees to cover costs already incurred. Specific cancellation terms will be stated in your project agreement.
We reserve the right to reschedule or delay a pour when weather or site conditions - including high temperatures, strong winds, or rain - would compromise the quality or safety of the work.
Payment terms are outlined in your signed project agreement. Typical arrangements include a deposit at project start and a final balance due upon completion. We accept the payment methods stated in your agreement.
Final payment is due upon substantial completion of the work described in the project agreement, unless otherwise agreed in writing. Accounts not paid within the terms stated in your agreement may be subject to a late fee and may be referred to a collections process.
Disputes about payment should be raised in writing within 10 days of the invoice date. We will work in good faith to resolve any billing concerns promptly.
We stand behind the quality of our work. Any specific warranty terms applicable to your project will be stated in your signed project agreement. In general, we will return to correct any defect in workmanship that appears within the warranty period and that is not the result of normal wear and tear, misuse, modifications by others, or conditions outside our control such as soil movement, tree root intrusion, or vehicular overloading beyond the slab design.
Natural hairline cracking in concrete is not a defect and is not covered under workmanship warranties. Control joints are installed specifically to manage where cracking may occur.
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
Information on the Site about services, processes, and costs is provided for general informational purposes only and may not apply to every project or property. Contact us directly for information specific to your situation.
To the fullest extent permitted by applicable law, Poway Concrete Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including loss of profits, loss of data, or property damage not directly caused by our negligence. Our total liability to you for any claim arising from or related to these terms or our services shall not exceed the amount you paid us for the specific project giving rise to the claim.
All content on this Site - including text, images, logos, and design elements - is the property of Poway Concrete Company or its content suppliers and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission.
If a dispute arises between you and Poway Concrete Company relating to these Terms or our services, we ask that you contact us first at estimates@powayconcretecompany.com so that we can attempt to resolve the matter informally.
If the dispute cannot be resolved through good-faith discussion, the parties agree to pursue resolution through binding arbitration or mediation before initiating any formal legal proceedings, except where the law requires otherwise. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in California.
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
